October 1st will see an end to people smoking in cars with young children. A change in the law will make it illegal to smoke in a private vehicle with anyone under the age of 18 present. If caught the smoker and driver could face a fine of £50 each.
The new law covers all drivers throughout England and Wales, including those aged 17 or drivers on a provisional license, however it will not apply to a driver aged 17 who is driving alone. Any private vehicle that is wholly or partly enclosed by a roof, including if the windows or sunroof are open, the air conditioning is on or if the smoker is sitting in the open doorway of the car will be affected. The only occasion it doesn’t apply is in a convertible with the rood completely down.
